CPCB Authorization: Professional refurbisher/recycler under the E‑Waste (Management) Rules, 2022
Welcome to CashOfOne.in (“CashOfOne,” “we,” “our,” or “us”). These Terms & Conditions (“Terms”) govern your access to and use of our website, mobile application, and related services (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms and all applicable laws in India.
1) Eligibility, Acceptance & Modifications
- Eligibility: You must be at least 18 years of age and legally capable of entering into a binding contract under Indian law.
- Acceptance: By accessing or using the Services, you agree to these Terms and our Privacy Policy and the policies referenced herein.
- Modifications: We may update these Terms from time to time. Changes are effective upon posting. Continued use after changes constitutes acceptance.
- Grievance Redressal: For grievances, contact our Grievance Officer (see Section 18).
2) Definitions
- “Seller” means a user who sells or offers to sell a device through the Services.
- “Buyer” means a user who purchases a refurbished device through the Services.
- “Device” means smartphones and related accessories listed, sold, purchased, or serviced through the Services.
- “Final Offer” means the binding purchase price issued post physical inspection and verification.
- “Condition Guide” means the objective criteria used for assessing device condition, available at Condition Guide linkand incorporated by reference.
3) Our Role: Aggregator & Marketplace; Limitation of Liability
- Platform & Logistics: CashOfOne provides the platform, logistics coordination, inspection, customer support, and compliance oversight.
- Transaction Principal: The final purchase contract is between you and the named counterparty (which may be Geenexa Waste Management LLP or a vetted third‑party buyer/refurbisher).
- Liability Framework:
- Where Geenexa is the stated Buyer, we act as principal and are responsible for that transaction.
- For third‑party counterparties, we provide reasonable vetting and mediation but are not liable for their independent actions except as required by law.
- Compliance: We operate consistent with the E‑Waste (Management) Rules, 2022 and applicable CPCB guidance.
4) Account Registration, KYC & Lawful Use
- Accuracy: You agree to provide accurate, current, and complete information.
- KYC: We may require KYC (self‑attested government ID, ownership transfer form, and other lawful proofs) to comply with anti‑theft/e‑waste obligations.
- Lawful Use: You must not use the Services for unlawful activities, including handling stolen, counterfeit, blacklisted, or FIR‑linked devices. We may report suspected violations to law enforcement and cooperate by sharing transactional details, including IMEI and KYC.
- Security: You’re responsible for safeguarding your account credentials and for all activities under your account.
5) Selling Your Device
5.1 Lawful Ownership & Indemnity
You represent and warrant that you are the sole and lawful owner of the Device, free of liens, financing restrictions, or legal encumbrances. You indemnify Geenexa and its affiliates against claims, losses, or costs arising from breach of this representation.
5.2 Condition Declaration, Inspection & Final Offer
- Online Quote: The initial quote is an estimate based on your declarations.
- Physical Inspection: A binding Final Offer is made only after physical inspection, diagnostics, and verification.
- Objective Criteria: Any price revision will be based solely on the objective criteria in the Condition Guide ([link]).
- Validity: A Final Offer is valid for [e.g., 24–72 hours] unless withdrawn earlier due to fraud/risk flags.
5.3 IMEI, Account Removal & Network Lock
You must ensure that:
- The IMEI is genuine and not blacklisted.
- All iCloud/Google/OEM accounts are removed, and FRP/activation locks are disabled.
- The Device is not network‑locked, unless explicitly declared and accepted.
Devices failing these checks may be rejected without compensation and may be reported to authorities if suspected stolen or counterfeit.
5.4 Prohibited Devices
We do not accept:
- Stolen or illegally obtained devices;
- Counterfeit/cloned devices;
- Devices blocked/blacklisted by telecom operators or government agencies;
- Devices linked to ongoing FIR/legal disputes;
- Devices with tampered IMEI or serious safety hazards.
5.5 Mandatory Data Erasure
- Your Responsibility: Before handover, back up your data and perform a factory reset/permanent data wipe. Remove SIM and memory cards.
- Our Process: We perform an industry‑standard secondary wipe on receipt.
- Liability: You remain primarily responsible for data present at handover. To the extent permitted by law, we are not liable for data loss, exposure, or residual data discovered later.
5.6 Documentation
You must provide:
- Self‑attested government ID;
- Ownership transfer form;
- Any additional declarations reasonably required to verify ownership and lawful status.
5.7 Pickup, Packing & Risk of Loss
- Pickup Confirmation: On pickup, our logistics partner will issue a pickup confirmation (digital or paper).
- Risk Transfer: Risk of damage or loss transfers to the Buyer only after pickup confirmation is issued.
- Pre‑Pickup Damage: We are not responsible for damage caused by improper packing/tampering before pickup.
5.8 Payment Terms (Sellers)
- Modes: UPI or bank transfer only (no cash).
- Timeline: For accepted Devices, payment will be initiated within 24–72 business hours after successful inspection and acceptance.
- KYC/Bank Mismatch: Payments may be delayed if bank details/KYC mismatch or if fraud checks are pending.
- Taxes: You are responsible for your personal income tax reporting.
5.9 Cancellation, Rejection & Non‑Completion
- Seller Cancellation: You may cancel a sell order any time before pickup without penalty.
- Right to Reject: We may cancel or reject any order if:
(a) the condition materially differs from your declaration;
(b) the Device is counterfeit, stolen, blacklisted, or account‑locked;
(c) documentation is incomplete/invalid;
(d) the Device poses safety/legal risk.
- No Dues on Rejection: No payment is due for rejected Devices. If already collected, the Device may be handed over to authorities if suspected illegal, or returned at your cost where lawful and feasible.
6) Buying Refurbished Devices
6.1 Transparency & Grading
- Devices are pre‑owned/refurbished and graded (e.g., Mint / Very Good / Good / Fair).
- Each product page discloses condition, cosmetic wear, battery health range (if available), accessories, and warranty coverage.
6.2 Limited Warranty
- Warranty Duration: Minimum 6 months (unless otherwise stated). See Warranty & Return Policy incorporated by reference.
- Coverage: Hardware defects under normal use.
- Exclusions: Accidental/impact/liquid damage; misuse; unauthorized repairs/mods; software/OS changes (rooting/jailbreak); consumables (e.g., protective films); normal wear.
- Remedy Order: At our discretion—repair, replacement (same or equivalent grade/spec), or refund.
6.3 Returns & Refunds (Defect/Not‑as‑Described)
- Window: 15 calendar days from delivery for items that are defective or not as described. Change‑of‑mind returns are not accepted.
- Process: Raise a request via [Returns page link] or app within 15 days; return with all accessories and IMEI‑matching Device in the same condition (reasonable wear excepted).
- Logistics Cost: We cover return logistics for valid claims.
- Inspection: Refunds are processed after return receipt and verification.
6.4 Dead on Arrival (DOA)
- DOA Window: 7 calendar days from delivery.
- Remedy: Fast‑track replacement or full refund after verification.
7) Pricing, Taxes & Invoices
- Seller Payouts: Based on Final Offer post inspection.
- Buyer Pricing: Displayed prices are inclusive/exclusive of taxes as indicated at checkout.
- GST Invoices: Provided where applicable; please add your GSTIN during checkout if you require a tax invoice.
8) Privacy, Data Protection & Communications
- DPDP Compliance: We process personal data per the Digital Personal Data Protection Act, 2023 and our Privacy Policy.
- Transactional Communications: We may contact you for order status, inspection, pickup, warranty, returns, and legal compliance.
- Marketing (Opt‑In Only): We will send marketing communications only with your explicit, separate, opt‑in consent. You may withdraw consent anytime.
9) Intellectual Property
All content on the Services (text, graphics, logos, software, images) is owned by Geenexa Waste Management LLP or its licensors and is protected by applicable copyright and trademark laws. You may not copy, modify, distribute, or create derivative works without prior written consent.
10) Acceptable Use & Prohibited Activities
You agree not to:
- Circumvent security features or misuse the Services;
- Interfere with operations (e.g., scraping, load testing without permission);
- Post or transmit unlawful, defamatory, infringing, or harmful content;
- Engage in fraud, deception, or money laundering.
11) Service Availability Disclaimer
The Services are provided on an “as is” and “as available” basis. We do not guarantee uninterrupted, timely, or error‑free access. Maintenance, upgrades, and outages may occur.
12) Force Majeure
We are not liable for delays or failures caused by events beyond reasonable control, including natural disasters, strikes, governmental actions, internet/power outages, logistics disruptions, or platform failures.
13) Indemnity
You agree to indemnify, defend, and hold harmless Geenexa, its partners, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of your breach of these Terms, unlawful use of the Services, or violation of rights of others.
14) Limitation of Liability
To the maximum extent permitted by law:
- We are not liable for any indirect, incidental, special, consequential, or punitive damages.
- Our total aggregate liability for any claim relating to your use of the Services or a specific Device transaction is limited to the amount paid by you for that Device (for buyers) or the Final Offer amount (for sellers), as applicable.
15) Governing Law & Dispute Resolution
- Governing Law: Laws of the Republic of India.
- Arbitration: Any dispute arising out of or in connection with these Terms shall be finally resolved by arbitration under the Arbitration and Conciliation Act, 1996, as amended.
- Seat & Venue: Bengaluru, Karnataka
- Language: English
- Arbitrator: Sole arbitrator appointed by mutual consent; failing which, appointed per the Act.
- Consumer Rights: Nothing herein restricts your statutory right to approach your local District Consumer Disputes Redressal Commission (Consumer Court) under the Consumer Protection Act, 2019, where you reside or where the deficiency occurred.
16) Termination & Suspension
We may suspend or terminate access to the Services, or cancel orders, where we reasonably suspect fraud, illegal activity, breach of these Terms, safety risks, or to comply with law or court/government orders.
17) Changes to the Services & Policies
We may change, suspend, or discontinue any part of the Services. Policies referenced herein (e.g., Privacy Policy, Warranty & Return Policy, Condition Guide) are incorporated by reference and may be updated from time to time.

20) Miscellaneous
- Severability: If any provision is unenforceable, the remainder remains in effect.
- No Waiver: Failure to enforce a provision is not a waiver.
- Assignment: You may not assign your rights without our consent. We may assign to an affiliate or successor.
- Entire Agreement: These Terms, together with linked policies, constitute the entire agreement between you and us regarding the Services.
- Survival: Provisions relating to ownership, warranty disclaimers, limitations of liability, indemnity, and dispute resolution survive termination.
